These Terms of Service ("Terms") govern your use of websites, applications, and digital products operated by Colossus Forge Studios, a division of Colossus Forge LLC ("we", "us", "our"). By using our products, you agree to these Terms.
1. Products and Services
Colossus Forge Studios develops and sells digital products including but not limited to:
- Portrait Forge — AI-powered character portrait creator
- NOAA Weather — Weather application
- Forge the Kingdom — Interactive visual novel
- PromptGrader — Prompt engineering education tool
- TripForge — Travel planning application
- Voice Agent Auditioner — AI voice agent testing tool
- Protect the Forge — Real-time strategy game
- Precursor — God game
Product availability, features, and pricing may change at any time.
2. Accounts and Access
Most of our products do not require an account. Where accounts or API keys are used:
- You are responsible for maintaining the security of your credentials.
- You must not share purchase tokens or pro-tier access with others.
- We may suspend access if we detect abuse or unauthorized sharing.
3. Purchases and Payments
- All payments are processed securely by Stripe. We do not store your payment information.
- Prices are listed in USD and include all applicable fees unless stated otherwise.
- Digital products are delivered instantly upon successful payment.
- Refunds: We offer refunds within 7 days of purchase if the product did not function as described. Contact colossusforge@pm.me with your purchase details.
- Credit packs and consumable purchases are non-refundable once used.
4. Acceptable Use
You agree not to:
- Use our products to generate illegal, abusive, or harmful content.
- Attempt to bypass rate limits, authentication, or security measures.
- Reverse-engineer, decompile, or extract source code from our applications.
- Use automated tools (bots, scrapers) to access our services without permission.
- Resell, redistribute, or sublicense our products or generated content for commercial purposes without authorization.
- Impersonate another person or misrepresent your identity.
5. AI-Generated Content
Some of our products use artificial intelligence to generate images, text, or other content:
- AI-generated content is provided "as is." We do not guarantee specific results.
- You retain the right to use AI-generated images created through your use of our products for personal and commercial purposes, subject to the terms of the underlying AI provider (Google Gemini, Replicate, etc.).
- You are responsible for ensuring your use of AI-generated content complies with applicable laws.
- We do not claim ownership of content you generate using our tools.
6. Intellectual Property
- Our products, websites, code, designs, and branding are owned by Colossus Forge LLC and protected by copyright and trademark law.
- Open-source components are licensed under their respective licenses (typically MIT), as noted in each repository.
- You may not use our trademarks (Colossus Forge, Portrait Forge, etc.) without written permission.
7. Third-Party Services
Our products integrate with third-party services including Google Generative AI, Replicate, NOAA, Stripe, Vercel, and Railway. Your use of these services is governed by their respective terms. We are not responsible for the availability, accuracy, or conduct of third-party services.
8. Disclaimers
- Our products are provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not guarantee uninterrupted or error-free service.
- We are not liable for any indirect, incidental, or consequential damages arising from your use of our products.
- Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
9. Free Tiers and Rate Limits
Free-tier access is provided at our discretion and may be modified or discontinued at any time. Rate limits exist to ensure fair usage and may be adjusted without notice.
10. Termination
We may suspend or terminate your access to our products if you violate these Terms. You may stop using our products at any time. Upon termination, any unused credits or tokens are forfeited.
11. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of our products after changes constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify users.
12. Governing Law
These Terms are governed by the laws of the State of New Hampshire, USA. Any disputes will be resolved in the courts of Rockingham County, New Hampshire.
